By registering yourself, you represent that: 

  a.. You are at least 18 years old. 
  b.. You are not disabled by any law from entering into a contract. 
  c.. You have gone through the Terms and Conditions and agree to be bound by them. 
  d.. You have understood various paid and free services offered by keralaconnect.com, as enumerated under Frequently Asked Questions. 

CHANGES TO THE TERMS AND CONDITIONS

keralaconnect.com, hereinafter referred to as 'TM' only, reserve the right to
change/modify/add/ delete the terms of this agreement.  All
changes/modifications/additions/deletions would be posted and it will be your
responsibility to refer the same on accessing this service. Changes/
modifications/additions/deletions of the terms of this agreement would come into
force, at once, after its first posting to the site and you would be deemed to have
accepted the same if you continue to access the site thereafter. 

MEMBERSHIP 

Mode: By registering your Profile through any of our domains [Listed in the
Annexure] or by remittance of fees, you become a Member of TM. 

Membership is not automatic: Right of admission vests with TM. You become a Member upon due acceptance by TM, of the Profile/Payment. 

Length of Membership: You continue to be a Member till; 

  a.. TM discharges its obligations to you by rendering of its Services to you; or 
  b.. Termination of the Membership by either of us. 

Privity of Membership: The membership is for your sole personal use and it shall not
be assigned, shared, transferred or licensed so as to be used by any other person.
You shall not authorise others to use your membership, and shall not assign or
otherwise transfer your account to any other person or entity. TM reserves its right
to cancel your right to access the site, without notice, once it is found that you
have assigned, shared, transferred or licensed your membership to any other. 

You are advised to make appropriate/thorough enquiries before acting upon any
matrimonial advertisement. TM does not vouch or subscribe to claims and
representations made by the respective advertisers regarding their status, age,
income of bride/groom, etc. 

Online Conduct: You are responsible for the content and information [including
profile and photograph] you post or transmit through TM's Services. You will not
post or transmit any content or information [in whatever form they may be contained] that is defamatory, blasphemous, abusive, obscene or sexually oriented, profane,intimidating, illegal or in violation of the rights of any person, including
intellectual property rights; no such content or information shall contain details
or particulars of any of TM's competitors, including their contact details. You will
not use your Membership either online of offline as a platform for any kind of
promotional campaign, solicitation, advertising or dealing in any products or
services or transmit any chain letters or junk mails. You hereby agree to indemnify
and hold harmless TM from any claim or demand made by any third party as a result of your conduct including attorney's fees and other expenses incurred by TM. 

There will be a limit for the number of profiles you are allowed to contact every
day, as fixed by TM. 

Your membership will be automatically suspended, without any notice, if you send any
"abusive, obscene or sexually oriented" message to other members. 

Messages sent to other members should be for the purpose of finding the life partner
alone.  If you send messages for any other purposes like friendship, etc., TM
reserves its right to terminate your membership automatically, without any notice. 

TM reserve the right to modify your profile, if any prohibitive or objectionable
content are found in it, or in case the contact details are entered in the fields
other than the fields where you are supposed enter the contact details like Phone,
E-mail, Address, etc. TM also reserves the right to modify your profile for any
other reasons not mentioned herewith. 

You should not post or transmit any content, information or trademarks without the
prior consent of the person holding proprietary or licensed rights thereof. You
should not send, submit, post or otherwise transmit messages or materials that
contain software virus or any other files that are designed to interrupt, destroy
and negatively affect in any manner whatsoever, any electronic equipment in
connection with the use of this site.  You should not engage in any cyber crime or
create any nuisance to any other member or third parties.  TM will not in any way be
responsible or answerable in an action brought by any person, arising out of your
acts as described above. You hereby agree to indemnify and hold harmless TM from any claim or demand made by any third party as a result of your conduct including
attorney's fees and other expenses incurred by TM. 

TM reserves the right but no obligation, to edit, delete, eclipse or withhold
display of such content or information as it deems fit in the light of the rules
prescribed above. 

REFUND OF FEE 

MEMBERSHIP FEES ARE NOT REFUNDABLE under any circumstances if you choose to
terminate the membership for whatever reason.

ROLE OF TM 

Provision of Service: TM will provide the service[s] as may be opted and paid for by
the Member. In addition, you may make use of such of the other free services as may
be applicable to you. 

A Standard paid membership will allow you to contact opposite gender profiles in the
domain in which you have registered the profile. A Premium membership will allow you
to contact the opposite gender profiles in all the domains hosted by TM. [Please
refer Annexure.] 

Medium of Interchange of Information: Besides the provision of the services, TM acts
as a platform for all its Members to interchange information that would promote
their common matrimonial objectives. It is to be distinctly understood that TM will
only provide contact between and among members within its service framework and not the direct contact details of such members. TM is not the agent of any Member and does not partake in the interchange or the results thereof. TM will be a
disinterested person in the event of disputes between or among the Members, though
it may facilitate, at its sole discretion, amicable resolution of such disputes, in
appropriate cases. 

Right to form Consortium/Associates: While providing Services, TM may outsource any part thereof to any competent person or organization, with or without disclosing it
to you. However, your Membership rights and responsibilities continue as against TM
only and not against such persons or organizations. 

GENERAL PROVISIONS 

Intellectual Property Rights: All rights [proprietary or otherwise, as the case may
be] including copyrights and trademarks in respect of the services, content,
information and data available on the non-public domain of the TM websites vest with
TM. You are not authorised to alter, modify, delete, copy, reproduce, sell or
transmit any part thereof in any manner whatsoever. 

Confidentiality: TM will maintain confidential, all personal information [other than
that meant for posting or transmission] furnished by the Members. However, TM may
divulge such information as may be required by law. 

Disclaimers and limitation of liability:

  a.. As to the Services: TM provides the Services on an "as is" basis and does not
  warrant in any way with respect to the merchantability, suitability or
  adaptability of the services. 

  b.. As to the infrastructure: TM promises to take all reasonable efforts for the
  continued, secure and uninterrupted availability of the Services. However, TM
  disclaims liabilities for interruption or non-availability of service, loss or
  damage of data due to infrastructure, mechanical and systemic failure/breakdown or
  due to events like rioting, war, Acts of God, Acts of State. In no event shall the
  liability of TM exceed the value of the Service[s] paid up by the Member. 

  c.. As to opinion, offers and advise: All opinions, offers, advises, statements,
  predictions made available through TM's websites are those of the respective
  authors and TM shall not be deemed to subscribe to or deny them in any manner. 

  d.. As to extraneous contents: TM hereby alerts and warns its Members of the
  possibility of unauthorised posting of contents by any person including Members
  and unauthorised users and advises discretion in access since such content,
  information or representation may not be suitable to you including being
  offensive. TM will not in any way responsible for such contents, information or
  representations. 

Termination of Membership: The Membership may be terminated by either party by
serving a written notice on the other. TM reserves the right to terminate the
Membership, suspend a profile or disable access in respect of any Member, in breach
of any of the terms, even without prior notice. In no case the Membership fees shall
be refundable. These terms and conditions will survive the Membership. 

Suggestions, Complaints, Disputes: Suggestions and complaints are to be first
addressed to TM to its Customer Support Department at info@tkeralaconnect.com. 

The Membership is deemed to have been entered into at Kochi, India and the laws of
India will govern the Membership. Disputes arising out of or in any way touching the
Membership including interpretation of any of the terms are to be referred to
arbitration under the Arbitration and Conciliation Act, 1996 [Indian Act], as
amended from time to time, at Kochi before a sole Arbitrator appointed by TM, whose
decision shall be final.
